Health and Safety
The Entertainer agrees to comply with all relevant health and safety guidelines for children's entertainment. The Client is responsible for ensuring the environment is safe and that the Entertainer is not exposed to any hazardous conditions. If the Entertainer feels the health and safety of the children or themselves is at risk, they reserve the right to stop the performance. Any children under the age of 3 (three) MUST always be accompanied or supervised by an adult as some props and balloons are not suitable due to choking hazards.

Insurance
The Entertainer holds public liability insurance of £2 million for the protection of the Client and the children during the performance. A copy of the Entertainer's insurance certificate can be provided upon request.

Payment - Private Customers (Parents, Guardians and Individuals)
The Client agrees to pay the Entertainer the agreed fee for the performance as set out in the contract. A deposit of £25.00 is required at the time of booking. After receiving the contract, the booking is not secure until the deposit is paid. The balance will be due four weeks before the event. The Entertainer also reserves the right to cancel if full payment is not received by the date agreed between the Client and Entertainer. Any extra services (e.g., extended time, additional activities) must be agreed upon in advance.

Payment - Businesses, Schools & Organisations
The Client agrees to pay the Entertainer the agreed fee for the performance as set out in the contract. A deposit of £25.00 is required at the time of booking. After receiving the contract, the booking is not secure until the deposit is paid. The balance will be due four weeks before the event, unless otherwise agreed. The Entertainer also reserves the right to cancel if full payment is not received by the date agreed between the Client and Entertainer. Any extra services (e.g., extended time, additional activities) must be agreed upon in advance. For organisations requiring post-service invoicing, full payment is due within 30 days of the invoice date (unless prior agreement states otherwise). Late payments will result in a £25 late payment fee and interest will also be charged at 2% per month on overdue amounts.

Cancellation Policy
- If the Client cancels the event at least 90 days before, the deposit will be refunded minus a 10% (of the full amount) administration fee.
- If the Client cancels at least 60 days before the event, the deposit will be forfeited.
- If the Client cancels less than 28 days before the event, the Entertainer will retain 50% of the total payment.
- If the Client cancels less than 5 days before the event, the Entertainer will retain ALL of the total payment.
- If the Entertainer cancels for any reason, all payments made will be refunded to the Client in full.

Responsibilities of the Client
The Client agrees to provide a safe and appropriate performance space for the Entertainer. Ensure the performance area is child-friendly and free from hazards. Provide any necessary equipment or props for the performance (if applicable and as discussed and agreed before the event). Ensure that children are supervised at all times during the event. Ensure there is adequate access to toilets, refreshments, and any other necessary facilities for the Entertainer. The Client is responsible for providing sufficient space for the Entertainer’s performance and any required electrical outlets or equipment. If outdoors, the Entertainer must be provided with adequate shelter from sun, rain, or strong winds. If weather conditions make the performance unsafe, the entertainer reserves the right to cancel or reschedule.

Force Majeure
Neither party will be held responsible for any delay or failure to perform their obligations under this agreement if such delay or failure is caused by any event beyond their reasonable control, including but not limited to extreme weather, illness, accidents, or other unforeseen circumstances.

Conduct and Behaviour
The Entertainer agrees to behave friendly and professionally at all times and ensure that their performance is suitable for children. The Client agrees to provide a suitable environment for the Entertainer to carry out their work.

Intellectual Property
The Entertainer retains ownership of all creative materials (e.g., scripts, songs, routines) used during the performance. The Client is not authorised to record, distribute, or reproduce the performance unless prior consent is given.

Child Protection
The Entertainer agrees to adhere to all relevant child protection and safeguarding policies and regulations. The Client is responsible for ensuring the children are supervised at all times. If the Entertainer feels the safety or well-being of the children is at risk, they reserve the right to stop the performance.

Licensing and Permits
The Client is responsible for obtaining any necessary permits, licenses, or permissions required for the event or the performance, including, but not limited to, those required by local authorities in Scotland. The Entertainer is not responsible for any failure to comply with such requirements.

Travel Costs
The Client understands that the Entertainer will charge 45p per mile over 5 miles from their home address ( G75). Any travel over 15 (Fifteen) miles to get to a location from the Entertainers home address (G75), requires a minimum payment for 1 hour 30 minutes as part of the booking. This is due to the Entertainer being unable to attend any further parties on that day.

Contract
Once the Entertainer and Client have agreed on the service, the Entertainer will provide the Client with a written Contract & Invoice. The Contract may be accepted by email and the £25 deposit – once received - will be deemed a valid and binding acceptance of this Contract. No physical signature is required for the contract to be effective. All Terms and Conditions mentioned above are included in the Contract for further reference.
